This lawsuit claims that the National Recovery Agency (NRA) violated the Telephone Consumers Protection Act (TCPA) by making unsolicited and unlawful debt collection calls to cell phones nationwide.
The TCPA was enacted in 1991 by Congress to address certain practices that were determined to be an invasion of consumer privacy and a risk to public safety. Among other things, the TCPA prohibits making any non-emergency call using an artificial dialing system or artificial or prerecorded voice to a cellular telephone number without prior express consent.
One plaintiff in this case, Linda Kennedy, is a resident of Murfreesboro, Tennessee. From early 2015 to November 2015, Kennedy received many unsolicited calls from the NRA. Man calls were either missed, robocalls, and voicemails left with only dead-air noise. The calls were collection calls on a consumer debt that did not belong to and was not the responsibility of Kennedy. These calls were placed using an automatic dialing system and Kennedy never gave the NRA permission to call her. The calls were not an emergency, in fact they were quite the opposite because the debt was not even Kennedy’s.
These calls were part of a larger NRA debt collection campaign in which it repeatedly made unsolicited calls to individuals’ cell phones without consent and in violation of the TCPA. The NRA did not verify the accuracy of consumers’ contact information or “scrub” cellular telephone numbers using publicly available reassigned number lists.
Based on the facts of the case, the plaintiffs in this lawsuit allege that the National Recovery Agency violated the Telephone Consumers Protection Act.
