McDaniel’s Classic Roast Ground Coffee Number of Cups Illinois Class Action

Moran Foods, LLC owns the Save-A-Lot chain of grocery stores, which offer deep discounts on national brands and many “private label” or store-brand products. At issue in this class action is its McDaniel’s Coffee Co. ground coffee, which comes in 30.5-ounce cans, because of what the complaint calls the “false, deceptive and misleading promise that each can makes “up to 240 cups” of coffee.

The class for this action is all those who live in Illinois who bought the product during the applicable statute of limitations.

The product is McDaniel’s Classic Roast (Medium) ground coffee. The bright-red can has a notation near the bottom that the container “Makes Up to 240 6 Fl Oz Cups” of coffee. On a side panel, it claims to be a quality product, with a blurb saying, “McDaniel’s coffee is not the same old grind. 100% Pure Coffee with no artificial flavors, colors or preservatives. Our beans are roasted to perfection to assure a consistently delicious cup of coffee every time.”

The same side of the can also contains the Brewing Instructions: “For best results, use one rounded tablespoon of coffee for each 6 oz. cup of water. Adjust these measurements to suit your taste. After opening, replace lid and store in a cool, dry place to preserve freshness.”

However, the complaint alleges, if you follow these instructions, the product will not make 240 cups of coffee or anywhere near that many. The complaint alleges, “Independent laboratory analysis determined that the product can only make 137 cups of coffee, over one hundred less than promised.” This is forty-three percent fewer cups than the label promises and than consumers believe they are paying for.

While the label does use an approximate term, “Makes Up To…,” the complaint claims “consumers will expect the target number is ‘in the ballpark’ of the actual number, even if it is not exact.” It says, “No reasonable consumer will expect the number of cups is closer to 130 than 230.”

The complaint charges, “[Moran] sold more of the Product and at a higher price[] than it would have in the absence of this misconduct, resulting in additional profits at the expense of consumers.”

The counts include breaches of warranties, violation of New York’s General Business Law, Negligent Misrepresentation, Fraud, and Unjust Enrichment.
