Maintamer Hair Damage Class Action Lawsuit

This lawsuit alleges that professional hair products company Innovative Styling Options, Inc., and parent Zotos International Inc. negligently created and marketed Maintamer Straightening System, a hair care product that caused hair loss and scalp damage, in violation of express and implied warranties provided by federal and California law.

ISO Maintamer Straightening System hair product (Product) is marketed and sold by ISO, a professional hair product brand owned and manufactured by Zotos, a wholly owned subsidiary of Shiseido, a leading global beauty company.  ISO products are sold internationally through online retailers as well as professional beauty stores and salons.  ISO markets the Product as “a 2-step straightening system that achieves unsurpassed smoothness, manageability, and shine, leaving hair in excellent condition. ISO Maintamer Straightner is ideal for smoothing coarse hair, taming unruly curls and waves, un-perming ends and controlling frizzy hair.”   Product advertising and packaging represent the Product to be “Thio-free”, “Lye-free” and “Virtually damage-free”.  ISO and Zotos also market the Product to customers with thicker, uncolored hair as their website claims the Product is “[i]deal for smoothing coarse hair, taming unruly curls and waves, unperming ends and controlling frizzy hair” and was designed for “tinted hair (up to 20 volume) or lightly high-lighted hair (up to 40%).”

In October 2013, a stylist applied the Product to Pittsburgh resident Gina Kilpela’s thick, coarse, frizzy and never colored hair.  Three days after application, Kilpela’s hair began falling out and, two weeks after application, large sections of her scalp were visible where her hair had completely broken.  Kilpela continued to experience increasing damage to her hair and scalp three weeks after application even after she requested damage remediation assistance and direction from ISO.

On October 30, 2015, Kilpela filed suit on behalf of herself and similarly-situated consumers seeking class action certification for those who purchased the Product based on false and misleading packaging, labeling and marketing representations made by ISO and Zotos and as a result, have incurred hair loss from use of the Product. The complaint alleges ISO and Zotos breached express and implied product warranties, violated the California False Advertising and Unfair Competition Laws consumer and the Moss-Magnuson Warranty Act, and acted negligently resulting in damage to users of the Product.  

The class action complaint seeks damages, including punitive damages, restitution, consequential damages, injunctive relief and attorney fees and costs.
