Magic Money Refunds After Astroworld Festival Cancellation Class Action

The Astroworld Festival, scheduled to be held November 5-6, 2021, came to a tragic end on its first day when some 50,000 attendees surged toward the stage and crushed others. Hundreds sought medical attention and ten died. The second day was canceled, but the complaint for this class action alleges that a number of companies owe festivalgoers refunds, for their purchases of “Magic Money” and for other costs. Named as defendants are Magic Money, LLC, Scoremore Holdings, LLC, Live Nation Worldwide, Inc. and Live Nation Entertainment, Inc., Ceremoney of Roses, LLC, and Cor Merchandising, LLC.

The Nationwide Class for this action is all individuals or entities who incurred costs for Astroworld Festival 2021, such as for Magic Money, and who were not given refunds after the cancellation of the festival.

In the alternative, Texas, Indiana, and California Classes have been defined, for residents of those states who incurred costs for Astroworld Festival 2021, such as for Magic Money, and who were not given refunds after the cancellation of the festival.

The Astroworld Festival was founded in 2018 by Travis Scott, a rapper and native of Houston. It was held at NRG Park, formerly the site of Six Flags Astroworld. This was the first year that the festival had expanded to two days.

Payments for the carnival rides and games were to be made via the Magic Money system. Festivalgoers paid through the Magic Money website or at the festival, and they were to use digital or physical Magic Money cards. The cards could be reloaded at a Magic Money kiosk or through the Magic Money app.

The complaint alleges that the advertising represented that festivalgoers would get “significant savings” as well as avoid long lines during the festival by prepaying. The complaint shows an image of an Instagram post saying, “Buy Your Astroworld Magic Money Cards Now! Save Money & Beat the Festival Lines.” Since festivalgoers were charged a service fee for each transaction, the complaint alleges, they appeared to benefit from prepaying a higher amount at their first transaction.

The festival opened at around 1:00 in the afternoon on November 5.

“Just after 9:00 p.m. that day,” the complaint alleges, “with about 50,000 festivalgoers in attendance, the chaotic and energetic crowd began to rush towards the stage when Scott began his set. Festivalgoers were crushed as they were surrounded by mosh pits with little to no room to escape and breathe. Festivalgoers begged that the show be stopped but were ignored.”

The result, the complaint claims, was “300 festivalgoers treated at the field hospital, 25 festivalgoers hospitalized, and 10 festivalgoers dead.”

Just before 6 a.m. the following morning, officials announced that the rest of the festival had been cancelled.

It alleges, “Defendants have yet to address refunds for those who purchased Magic Money.”
