Love Good Fats Bars Saturated Fats and Health Claims Class Action

The Good Fat Co. Ltd. (GFC) makes snack products in various flavors that the complaint for this class action alleges are marketed to seem healthy. However, the complaint claims that the snacks “contain unhealthy levels of saturated fat” that can put people at increased risk of heart disease.

Various pages of the complaint show images of the bars at issue, with “Love Good Fats” in the largest font on the front. The label also prominently features the amount of protein, sugar, and net carbs.

The complaint alleges that GFC markets the products in a way that makes them seem healthy. Page 3 shows an ad with the title, “there are benefits to including good healthy fats [in] your diet.” The text says, among other things, “Need more reasons to add more good fats to your diet? They give you energy, support your metabolism, and are a super fuel for your brain.” A Facebook ad says, “Learn about the delicious easy way to add healthy fats to any diet.”

But the complaint alleges that the marketing for the products is “false, misleading, and deceptive because [GFC’s] Products contain high amounts of unsafe fats which increase the risk of severe health issues, including coronary heart disease—the number one killer of Americans every year.”

Also, the complaint claims that companies that make certain health-related nutrient claims on their products’ labels must meet requirements and make disclosures, and that GFC does not do so. On GFC’s Instagram posts, the complaint alleges, it uses hashtags like “#healthyfood” and “#healthy[.]”

Even so, the complaint claims, “Each product contains 6 to 8 grams of saturated fat.” “For example,” the complaint says, the Lemon Mousse and the Mint Chocolate Chip flavors contain 7 grams of saturated fat which is more than the amount of saturated fat in two large orders of McDonald’s fries.”

The complaint contends that saturated fat increases the risk of cardiovascular disease because it contributes to the buildup of plaque in the arteries.

According to the complaint, GFC “fails to include mandatory disclosure statements that must alert consumers to examine the Nutrition Information because the Product contains high levels of fat and saturated fat. These disclosures are mandatory because the Product contains numerous nutrient content claims, and … they are required so consumers can put these claims in their proper context.”

Three classes have been proposed for this action:

  • The California Class is all persons who bought the products in California, within the applicable statute of limitations.
  • The Multi-State Consumer Class is all persons in California, Florida, Illinois, Massachusetts, Minnesota, Missouri, New Jersey, New York, Pennsylvania, Oregon, and Washington who bought the products.
  • The Nationwide Class is all persons who bought the products in the US, within the applicable statute of limitations period.

  • Chocolate Chip Cookie Dough
  • Coconut Chocolate Chip
  • White Chocolatey Strawberry
  • Cookies & Cream
  • Salted Caramel
