Litigation Practice Unwanted Telemarketing TCPA Class Action

The Telephone Consumer Protection Act (TCPA), the complaint for this class action alleges in its first paragraph, “was a response to Americans ‘outraged over the proliferation of intrusive, nuisance calls to their homes from telemarketers[.]’” But consumers, it seems are still being outraged: The complaint alleges that the Litigation Practice Group, PC made unsolicited telemarketing calls to a residential number that is on the National Do Not Call Registry.

The National Do Not Call Registry Class is all persons in the US (1) whose telephone number were on the National Do Not Call Registry for at least thirty-one days (2) when they received more than one telemarketing call from or made on behalf of the Litigation Practice Group (3) within a twelve-month period, (4) between February 24, 2018 and February 24, 2022.

“The National Do Not Call Registry … allows consumers to register their telephone numbers and thereby indicate their desire not to receive telephone solicitations at those numbers[,]” says the complaint. It quotes the law as saying that the listing “must be honored indefinitely, or until the registration is cancelled by the consumer or the telephone number is removed by the database administrator.”

The number for the plaintiff in this case, Gerard Jackson, has been on the National Do Not Call Registry since December 4, 2006.

Even so, the complaint alleges, Litigation Practice placed calls to Jackson more than once in 2022. The complaint claims it placed telemarketing calls to him on January 7, 10, 12, 17, 20, 25, and 31, and February 1, 2022.

Litigation Practice provides debt referral or relief services. All of the calls offered similar messages, the complaint alleges: “The telemarketer stated that they were calling regarding credit relief and they [inquired] regarding the amount of debt that [Jackson] had.”

According to the complaint, the calls were unwanted, but they kept coming, so, on January 31, 2022, Jackson spoke to the representative to find out what company he was calling from. The representative, the complaint alleges, sent him an email the following day, “that confirmed … that the purpose of the call was to acquire Mr. Jackson’s business.”

The email provided a website URL for the company, the complaint claims, and “promoted [Litigation Practice’s] services, indicating that they had been in business for over 20 years.”

Jackson claims he never gave consent or asked for these calls.

The complaint alleges that Jackson and the other people Litigation Practice telemarketed to had their privacy violated, “they were annoyed and harassed, and, in some instances, they were charged for incoming calls. In addition the calls occupied their telephone lines, rendering htem unavailable for legitimate communication.
