Lippert Defective Axles on Towable RVs and Frame Failure Class Action

This class action is about axles in towable recreational vehicles (TRVs). The complaint alleges that axles made by Lippert Components, Inc. (LCI) have a defect that results in damage to the TRV’s frame. The axles are installed in TRVs, including the Forest River Surveyor TRV made by Forest River, Inc. and sold by DeMartini RV Sales.

LCI makes components for RVs. Its website claims that “state-of-the-art robotic welders ensure the highest precision and quality on every component” and that every component is created meet “high standards” through “rigorous testing.”

The complaint alleges that this is not true: “Instead, these shoddy Axles contain a defect impeding their structural integrity and causing the frames of the TRVs in which they are used to prematurely fail at a high rate.” This makes “temporary repairs futile” and diminishes the TRV’s functionality and value.

Plaintiff Christie Sheets bought a new 2018 Forest River Surveyor TRV in June 2017 from the DeMartini dealership in Grass Valley, California. The TRV was equipped with LCI axles.

In July 2019, she and her husband were towing the TRV on a trip when she noticed an odd smell coming from it. The complaint alleges, “By the time they arrived at their destination…, they observed that the shackle had broken off the frame, causing the frame to ride directly on top of the tire.”

The couple were able to find an emergency welder to provide a temporary fix. However, “[t]he welder informed [Sheets] that the frame’s integrity had been irreparably damaged and therefore, he could not recommend a permanent patch to repair the Axle.” The TRV had roughly 10,000 miles on it.

Sheets consulted with several repair places, the complaint says, “all of which similarly confirmed that the Subject TRV frame’s structural integrity had been compromised and therefore, repair was not advisable.”

Sheets has contacted DeMartini RVs and Forest River three or four times about this defect. According to the complaint, however, “DeMartini RVs and Forest River repeatedly denied the existence of the Defect in the Subject TRV and asserted there was no applicable warranty to cover [Sheets’s] damages.”

The complaint says that other consumers report problems with the axles in a variety of TRVs, including “Axles breaking at the spindle, breaking at the shackle weld, wheels falling off, the frame splitting under the TVL’s slide out, cracks, bad welding, over-flexing and general cracking and breaking of the frame.”

Two classes and a subclass have been defined for this action.

  • The California Class is all persons who bought a Forest River TRV in California that was equipped with an LCI axle, within the applicable statute of limitations.
  • The Nationwide Class is all persons in the US who bought a Forest River TRV equipped with an LCI axle, within the applicable statute of limitations.
  • The California Implied Warranty Subclass is all persons who bought a Forest River TRV equipped with an LCI axle from DeMartini RV Sales in California, within the applicable statute of limitations.
