LG Energy Solution Solar Batteries Risk of Fire California Class Action

The defendant in this class action is LG Energy Solution Michigan, Inc. (LGESMI), but the matter concerns the company’s business or actions in California. The complaint alleges that LGESMI sold LG RESU batteries for solar power systems that do not work as advertised, and that can cause fires and property damage.

The class is not cleared stated in this action, but is implied to be all those in California who bought LG RESU batteries, between October 6, 2018 and October 6, 2021.

According to the complaint, the batteries at issue are supposed to “pair with a home solar system and connect directly to a storage-ready solar inverter for charging and discharging.”

During the day, solar energy systems may produce more energy than the home uses. That energy may be stored in a battery and then used to power the home either after the sun goes down or during a conventional power failure. The complaint alleges that LGESMI markets this as “battery arbitrage.” The battery systems, the complaint claims, cost “several thousands of dollars each.”

The complaint claims that LGESMI has “sold battery storage systems that do not work as represented to thousands of Californians. These batteries are dangerous and several have caused fires and property damage. Because of these safety concerns most, if not all, of these batteries[] have been taken out of service.” While some of the batteries may still be in operation, the complaint alleges that they “pose a dangerous safety risk.”

The complaint alleges that LGESMI represented that the batteries were safe for use in homes and that they “provide the ability to (1) store energy during the day and then use that stored energy when electric companies charge the highest rates, (2) use stored energy in the event of a power failure, and (3) [] do so safely,” and that these representations are not true.

According to the complaint, “LGESMI has admitted that its batteries are defective and offered to replace some of them…. However, based on information and belief, LGESMI has not done so for a period of approximately one year, claiming the ability to obtain adequate replacement component parts, while at the same time selling new, non-defective batteries to new customers.”

The causes of action alleged by the complaint are violations of the California Consumer Legal Remedies Act (CLRA), which prohibits a variety of unfair or deceptive practices in sales or leases of goods, and violations of California’s Business and Professions Code, which prohibits unfair business acts and practices and unfair, deceptive, untrue, or misleading advertising.
