LG Electronics Air Conditioning Unit Corrosion Hawaii Class Action

LG Electronics, Inc. and LG Electronics USA, Inc. make electronic appliances. This class action concerns their packaged terminal air conditioner (PTAC) units, which the complaint alleges are suffering corrosion, which leads to failure of the condenser, evaporator, and connective tubing and to leaks of refrigerant. The complaint alleges that the units “are unfit for installation in the tropical climate in the State of Hawai’i.”

The class for this action is all individuals and entities in Hawai’i who own LG PTAC systems made and sold by LG, specifically model numbers LP073CDUC, LP123CDUC, and LP153CDUC as well as all of the PTAC units sold and installed in Hawai’i on or after Apri130, 2016, including the following model numbers:

  • LP***CD2B
  • LP***HD2B
  • LP***CD3B
  • LP***HD3B
  • LP***CDUC
  • LP***HDUC

The complaint alleges, “Extensive corrosion has occurred in the components of the sealed refrigerating system.” Components of the system, such as the heater, heater protections, solenoids, capacitors, wiring and hardware, have also corroded, along with the framing, screws, nuts, and bolts for the system.

The corrosion has led to the leaking of refrigerant into pipes, tubes, and condensers. These leaks keep the units from operating properly. In addition, the complaint alleges, “Refrigerant leaks pose a danger to human health.”

The units are covered by three different warranties, promising varying coverage for repairs or replacements in the first year or first five years of use.

The complaint claims that the plaintiffs in this case sent a warranty claim on April 30, 2021, on behalf of all owners of the PTAC units in Hawai’i. The complaint alleges, “Due to the environmental conditions in the State of Hawai’i—including elevated atmospheric chloride levels—LG PTAC units are expected to significantly and prematurely corrode, causing refrigerant leaks impeding the ability of the LG PTAC units to function properly.”

The complaint points out that the Limited Warranty Exclusions and Limitations part of the LG warranty includes “Property damages, malfunctions or failure of the product or personal injury caused by or resulting from … Operating the Product in a corrosive coastal environment, or in an environment containing corrosive chemical agents or other hazardous chemicals…”

The complaint alleges that this shows that LG was “aware that a ‘coastal environment’ is corrosive for the LG PTAC units.” However, the complaint says, the company shipped units to the state that they knew were unfit for use there.

The counts include breaches of warranties and violations of Hawai’i state laws against unfair business practices.
