Land Rover 2017 Discovery Windshield Water Breach Class Action

The vehicles made or sold by Jaguar Land Rover North America, LLC are purported to be luxury vehicles. But the complaint for this class action alleges that the 2017 Land Rover Discovery has a windshield defect that allows water to enter, which can cause damage, including the destruction of the vehicle’s computer system.

The Nationwide Class for this action is current and former owners or lessees of a 2017 Discovery.

TH Chiro, PLLC bought a new 2017 Land Rover Discovery in November 2017.

At some point in 2019, the complaint says, the Discovery “suffered a major water breach around its windshield.” The complaint claims that the water breach was due to a defect in the windshield.

When TH Chiro’s principal was driving the vehicle on or about December 5, 2019, the complaint says, the computer system failed: “all dashboard controls, signals, instrumentation or messaging stopped functioning.” According to the complaint, the failure was caused by the water breach, and it led to a very dangerous condition on the road.

The complaint says that the principal took the vehicle in to the Land Rover dealership. The complaint claims, “TH Chiro learned from Land Rover dealership personnel that the defective windshield was a common problem with Land Rover Discovery vehicles.”

The dealership did not complete the repair promptly, the complaint alleges, keeping it for approximately two months before calling TH Chiro to announce that it was ready for pickup.

However, the complaint alleges that the vehicle was not ready for pickup: “While it is possible that the windshield defect had been repaired and computer system had been repaired, the Discovery was moldy.” This, the complaint alleges, was because “[t]he dealership had allowed the Discovery to remain closed up, uncleaned, wet, and soggy for approximately two months, thereby resulting in mold growing in the Discovery.”

TH Chiro refused to accept the vehicle in that condition. The complaint claims, “Since that time, TH Chiro has been attempting to obtain a resolution of the problems with the Discovery. Land Rover has failed to provide any resolution.”

Because the situation is still unresolved, TH Chiro has now not had the use of the vehicle for approximately five months.

According to the complaint, Land Rover should have warned purchasers or lessees that the vehicle had a windshield defect. The complaint alleges fraud, violation of consumer protection laws, breach of warranty, and breach of the duty of good faith and fair dealing.
