Irwin Naturals claims—in its name and its advertising—that its products are “natural,” says the complaint for this class action. However, the complaint alleges this is false, deceptive, and misleading because Irwin’s products contain synthetic ingredients that are not natural. The counts include breaches of warranties among other things.

Consumers are increasingly concerned about using products that contain synthetic or chemical ingredients, in the areas of food, cleaning and household products, and bath and beauty items.

Consumers are willing to pay more for items that are natural and do not contain synthetic or chemical ingredients. The complaint alleges that companies like Irwin are taking advantage of this to charge a premium for their products

The complaint shows images of the product bottles and lists synthetic ingredients contained in each. These include gelatin, glycerin, soy lecithin, dextrin, titanium dioxide, maltodextrin, carboxymethylcellulose, niacin, riboflavin, thiamine, and silicon dioxide. No product has fewer than four synthetics listed; one has twelve.

It then reviews each synthetic substance. For example: “Gelatin is a synthetic ingredient that is commercially processed using hydrolysis” or “Ascorbic Acid is a chemical preservative and is synthetic.” Some of descriptions cite parts of the Code of Federal Regulations or other references.

The US Department of Agriculture (USDA) has published a draft decision tree as guidance for how to determine if a substance is natural or synthetic. According to this tree, the complaint alleges, “a substance is natural … if: (a) it is manufactured, produced, or extracted from a natural source…; (b) it has not undergone a chemical change … so that it is chemically or structurally different than how it naturally occurs in the source material; or (c) the chemical change was created by a naturally occurring biological process such as composting, fermentation, or enzymatic digestion or by heating or burning biological matter.”
