IFit NordicTrack Treadmills Warranty Repairs Class Action

What do you do when you buy an expensive product—for example, a treadmill from iFit, Inc., which does business under the NordicTrack brand—and it stops working? Go after your warranty, naturally. But what if the company does not get around to the repairs in a reasonable length of time? Or if the product breaks too often? The complaint for this class action alleges that iFit breaches its warranties for its treadmills.

The class for this action is all consumers who, between the applicable statute of limitations and the present, bought a class product and had the class product come to a complete stop while it was running, where it would not turn back on.

The plaintiff for this class action Matthew Treinish, bought a Commercial 2950 treadmill from the company, which, with in-home delivery and assembly, cost him $3442.69.

The treadmill came with a warranty saying that the treadmill would be “free from defects in workmanship and material, under normal use and service conditions.” The different components had different warranty coverages: the treadmill frame was warranted for ten years from the date of purchase, the treadmill’s parts were warranted for two years from the date of purchase, and the labor was warranted for one year from the date of purchase.

Treinish bought the treadmill on or around October 27, 2021. Since then, the complaint alleges, at times when he was running on it at full speed, it has on three separate occasions come to a total stop. After that, it would not turn back on.

Treinish has asked the company to fix his treadmill “numerous times,” he says. However, each time, the complaint claims, “this process took four weeks or longer” after the treadmill broke down. “As a result,” the complaint alleges, Treinish “has had significant periods of time where he cannot use the treadmill which he paid valuable consideration for.”

The complaint makes an even more fundamental accusation: “The repeated malfunctioning of [Treinish’s] treadmill constitutes a breach of [iFit’s] warranty to [Treinish].”

The causes of action including violation of California’s Unfair Competition Law, with the complaint citing the unfair, fraudulent, and unlawful prongs of the law. Other causes of action are breach of warranty and breach of implied warranty under both California’s Song-Beverly Consumer Warranty Act and the federal Magnuson-Moss Warranty Act. The complaint asks that the court require the company to “engage in corrective advertising” and pay actual and punitive damages, attorneys’ fees and costs, and pre- and post-judgement interest.
