ICE Cruise Spam Calls Class action Lawsuit

A class action lawsuit has been filed in a California court against International Cruise & Excursion Gallery, Inc. for repeatedly violating the Telephone Consumer Protection Act by calling prospective customers without their consent. Class members affected in this suit are estimated in the thousands or more.

Los Angeles resident Kamille Coulter filed the suit, claiming that on October 20, 2015, she began receiving calls on her cell phone regarding loyalty rewards for an international cruise. An automated telephone dialing system was used from what is believed to be an internet-generated spoof number. The complaint states the class members were illegally contacted because they did not issue their phone numbers to International Cruise, they were contacted without prior consent, and they incurred charges or reduced phone time for which they had paid, due to having to retrieve messages left by the company. The suit also alleges privacy invasions.

International Cruise & Excursion Gallery is a Delaware corporation with its principal place of business in Scottsdale, Arizona. The company describes its mission, “to be a leading global market maker in the leisure industry” by utilizing “direct to consumer marketing.” Yet, the lawsuit contends International Cruise violated the Telephone Consumer Protection Act in its aggressive marketing tactics.

According to the Act, the company cannot make automated calls using an artificial or prerecorded voice to any cell phone number without that owner’s prior consent. The calls were willful and negligent of the law on the part of International Cruise & Excursion Gallery. The class members include all cell phone owners who received automated calls from the company without prior express consent.

Kamille Coulter seeks up to $1,500 for each call she received from International Cruise that violated the Telephone Consumer Protection Act. This number may exceed five million dollars when applied federally to all those affected in the class action.
