Honda, Acura Vehicles Exploding Sunroofs Class Action

How would you feel if you were driving along in your car and the sunroof suddenly exploded, showering broken glass over you and your passengers? The complaint for this class action alleges that that’s what can happen with the sunroofs or moonroofs in certain 2015-2020 Honda and Acura vehicles from American Honda Motor Co., Inc. According to the complaint, this sunroof defect, with its “loud explosion and flying glass” creates a danger for the people in the vehicle as well as for others on the road.

The class for this action is all persons or entities in the US who bought or leased a class vehicle. The class vehicles are 2015-2021 Honda and Acura vehicles with sunroofs or moonroofs made with tempered glass. Missouri, Washington, and Florida Subclasses have been proposed for those who bought or leased a class vehicle in those states.

One of the plaintiffs in this case, Dustin Fulcomer, bought a new 2019 Acura TLX in October 2020 in Florida. Around December 10, 2020, Fulcomer was driving the vehicle, which had only around 300 miles on it, when he heard an explosion.

In shock, Fulcomer pulled over got out to check on the problem, but the complaint says he did not see anything that might have made the glass shatter.

Although the vehicle was still under its three-year, 36,000-mile limited warranty, the dealership refused to cover the shattered sunroof. Instead, it offered him a $30 coupon. He eventually paid $1,600 for replacement of the sunroof.

The complaint alleges that the exploding sunroofs are made with tempered glass, which is heated, then quickly cooled. According to the complaint, “This tempering process creates an outer layer of compression that is shrink-wrapped around the middle of the glass, which is constantly pressing outwards. If the outer layer is compromised, then the entire piece of glass explosively shatters.”

When the tempered glass is put into a frame, that can increase the stress, the complaint says, particularly when the glass expands or contracts with changes in temperature; other potential manufacturing flaws can also increase the stress on the glass. Furthermore, the complaint alleges that auto makers are under pressure to increase fuel efficiency, which leads them to use thinner glass in sunroofs.

The complaint alleges that other manufacturers use laminated glass to make sunroofs. Laminated glass joins two or more panes of annealed glass with a layer of plastic or polyvinyl butyral (PVB). If this kind of glass breaks, the complaint claims, it will cling to the plastic and hold its form instead of dropping.

The complaint alleges that Honda has known about the problem for a long time but has not contacted owners or lessees about it and has not remedied the problem.

The complaint quotes a variety of online consumer complaints about the problem.
