Hertz Wrong or Reassigned Number Calls TCPA Class Action

The Hertz Corporation is known for its vehicle rentals. But the complaint for this class action alleges that it has been making repeated robocalls to consumer cell phone numbers, which appear to be wrong or reassigned numbers. The complaint alleges these calls violate the Telephone Consumer Protection Act (TCPA).

The plaintiff in this case, Annette Bayles, has only one phone—her cell phone. She began receiving calls from Hertz in May 2022, which the complaint says were directed to someone other than Bayles and unknown to her. The complaint alleges she received at least ten calls from Hertz and that an artificial or prerecorded voice was used in connection with the calls.

The complaint reproduces the text of at least one of the artificial or prerecorded messages: “This is the Hertz Corporation calling on behalf of Hertz, Dollar, or Thrifty. Our records indicate the vehicle you rented is overdue. It is urgent you contact us at 800-552-8482 option 2 to discuss the return of your rental. Please provide the following rental agreement number when you call.”

However, the complaint alleges Bayles did not have a rental from Hertz and is not aware of any connection with anyone who does.

The call came from a number that NoMoRobo has listed as a robocaller.

On May 9 and May 11, the complaint claims, Bayles told Hertz that it was calling the wrong person, but the company continued to place calls to her number, using an artificial and prerecorded voice.

A class and a subclass have been defined for this action:

  • The class is all persons in the US (1) to whom Hertz placed or caused to be place a call (2) to a number assigned to a cell phone service but not assigned to a Hertz customer, accountholder, or authorized user, (3) in connection with which Hertz used an artificial or prerecorded voice, (4) between May 26, 2018 and the date the class is certified in this case.
  • The subclass is all persons in the US (1) to whom Hertz placed or caused to be place a call (2) to a number assigned to a cell phone service but not assigned to a Hertz customer, accountholder, or authorized user, (3) in connection with which Hertz used an artificial or prerecorded voice, (4) after the called party told Hertz that the telephone number it had called was a wrong or reassigned number, or told Hertz to stop placing calls to the telephone numbers, (5) between May 26, 2018 and the date the class is certified in this case.
