HappyFamily, HappyBaby Foods Heavy Metal Content Montana Class Action

Nurture, Inc. makes HappyFamily Organics, a line of baby food and other food products. The complaint for this class action alleges that these foods contain “high levels of arsenic, mercury, lead, cadmium, and perchlorate—all of which are known to pose significant health risks to humans, particularly infants.” To support this, it refers to a report from a House of Representatives Subcommittee on Economic and Consumer Policy, Committee on Oversight and Reform.

The class for this action is all those in Montana who bought the products containing unsafe levels of toxic metals or other poisons during the applicable statutes of limitations.

The Subcommittee report, the complaint alleges, “was based on the submission of internally conducted test results and company documents. In other words, [Nurture] had knowledge that its baby foods contained dangerous levels of toxic heavy metals and chemicals, but it still marketed and sold them.”

Nurture sells foods under the HappyFamily Organics and HappyBaby brands. The complaint quotes Nurture’s description of itself as “a team of real parents, pediatricians & nutritionists on a mission to bring health and happiness to our little ones and the planet.”

The complaint also quotes some of the company’s claims about its products:

  • “The perfect first snack for baby’s developing gums…”
  • “When it comes to caring for your baby, transparency is everything.”
  • “Mindfully Made: We develop premium organic recipes perfectly matched with your child’s age and stage.”
  • “Certified USDA organic ingredients; Non-GMO Project Verified[;] No added sugar, preservatives, colors or artificial flavor.”

The complaint alleges that these kinds of statements make the foods seem safe. “Not only do the Products not inform consumers that they contain harmful contaminants, the labels specifically state what harmful elements they do exclude … encouraging consumers … to trust that Nurture has removed harmful and toxic contaminants from their Products.”

However, the February 2021 Subcommittee report noted that the products contained concerning levels of arsenic, mercury, lead, cadmium, and perchlorate. However, the Subcommittee did not test all of Nurture’s products. This means, the complaint claims, “the full extent of toxic metal and chemical contamination is not known at this time…”

The Food and Drug Administration (FDA) and World Health Organization (WHO) have found that these substances are harmful, particularly to children and babies. The complaint quotes the report as saying that heavy metals “can harm a baby’s developing brain and nervous system” and may have other impacts such as a “permanent loss of intellectual capacity and behavioral problems like attention-deficit hyperactivity disorder (ADHD).” Research shows that the heavy metals present “troubling risks for babies, including cancer and lifelong deficits in intelligence.”

The complaint reviews the findings for arsenic, lead, cadmium, and mercury in the Nurture baby foods.
