HappyBABY Baby Food Contains Heavy Metals Class Action

Eighteen plaintiffs bring suit against Nurture, Inc. in this class action alleging that the company permitted heavy metals in its HappyBABY baby food. The complaint relies on a February 4, 2021 House of Representatives Committee on Oversight and Reform Subcommittee on Economic and Consumer Policy, entitled, “Baby Foods Are Tainted with Dangerous Levels of Arsenic, Lead, Cadmium, and Mercury.”

The class for this action is all persons in the US who bought HappyBABY brand baby food. Subclasses have also been proposed for California, Colorado, Florida, Georgia, Illinois, Kentucky, Maryland, Michigan, Missouri, Nevada, New Hampshire, North Carolina, North Dakota, Tennessee, Virginia, and Washington, DC.

The complaint alleges, “The dangerous effects of these toxins are exacerbated and can be indelible in developing and vulnerable bodies and brains of babies and children, who FDA explains are at the greatest risk of harm.” It refers to the Report to declare, “Exposure, such as ingestion, of Toxic Heavy Metals by babies and children leads to untreatable and permanent brain damage, resulting in reduced intelligence and behavioral problems. For instance, scientific studies have connected exposure to lead to a substantial decrease in children’s total IQ points and their lifetime earning capacity.”

Happy Babies Bright Futures, an alliance of nonprofits, scientists, and donors, produced an earlier report on baby food believes that baby food should have no measurable amounts of these toxic heavy metals.

The Subcommittee Report tested various baby foods. As to arsenic, according to the complaint, “HappyBABY Brand Baby Food[s] were sold typically containing 60 ppb arsenic and over 25% of the products contained more than 100 ppb arsenic and as much as 180 ppb arsenic.” The complaint claims, “The levels of toxic arsenic in [Nurture’s] baby food far exceeded the 10 ppb limit the FDA has set for arsenic in bottled water that is legal to sell to any consumer, even full[-]grown adults.”

The complaint claims, “Nurture tested and then sold HappyBABY Brand Baby Food products with as much as 641 ppb lead, and 20% of all finished HappyBABY Brand Baby Food products contained greater than 10 ppb lead.”

Similarly concerning results were found for cadmium and mercury. The complaint claims, “Sixty-five percent of HappyBABY Brand Baby Food finished products contained more than 5 ppb cadmium.” Also, it says, “Fifty-six products tested and later sold contained more than 2 ppb mercury, which exceeds the highest level of mercury that the EPA allows in drinking water.”
