
HahaSmart, Inc. and Affiliate Solar, Inc. sell solar panels to homeowners across the country. The complaint for this class action alleges that the companies sell them by advertising and verbal sales pitches that tell potential customers that they will save money with a solar energy system. However, the complaint claims, in many cases, the customers who do buy the systems do not save money and may actually lose money.
Two classes have been defined for this action:
- The Alabama Class is all customers of HahaSmart and Affiliate Solar who bought solar PV systems for property in Alabama, during the applicable statute of limitations, who did not save money by buying the solar PV system.
- The Nationwide Class is all customers of HahaSmart and Affiliate Solar who bought solar PV systems, during the applicable statute of limitations, who did not save money by buying the solar PV system.
The complaint says HahaSmart and Affiliate advertised and sold a solar energy system to the plaintiff for this action, Norman Walton, who lives in Alabama.
Attached to the complaint are Exhibits A-E, which show marketing on the Affiliate website, the HahaSmart website, HahaSmart’s Facebook page, and Affiliate’s Instagram page, on April 13, 2022. For example, the complaint shows an item from Affiliate’s website that says, “Go Solar. Start Saving” and quotes HahaSmart’s website as saying, “Enjoy savings. Share with friends.” It quotes HahaSmart’s Facebook page as saying, “Save money when you go solar with HahaSmart!” and a line in an Affiliate Instagram post saying, “Own your own power, save money, and help the planet!”
However, the complaint alleges that in many cases those who do get solar power do not save money. Walton eventually bought solar panels for his home from the two companies at a price of $55,000.
The complaint also claims that the companies made other representations to Walton:
- “On multiple occasions between December 14, 2020 and January 21, 2021, the authorized salesman for Affiliate named ‘JD’ orally represented to [Walton] that the would save money if he bought the solar PV system.”
- “One of the owners of both Defendants, Kim Eaves, told [Walton] on the phone in December 2020 and January 2021 that he would save money by purchasing the solar PV system, ratifying the representations of her salesman, JD.”
- “These representations continued until July of 2022 wherein [Walton] was informed that he would not, in fact, save money due to the purchase of the solar PV system.”
The companies deceived Walton by claiming he would save money if he bought a solar PV system from them, the complaint alleges, when in fact he lost money.
The complaint claims violations of the Alabama Deceptive Trade Practices Act, the California Business & Professions Code, and the California Legal Remedies Act.
