Gobble Alleged to Use Unfair Subscription Renewal Class Action

Gobble is a company that offers subscriptions to “meal kits”, or partially-prepared meals, so that subscribers can make supposedly “gourmet” meals in ten minutes with one pan. This class action alleges that the company uses unfair and unlawful means to renew subscriptions to their meal service.

The class for this class action includes all persons in California who purchased a subscription from Gobble as part of an automatic renewal plan or continuous service offer within the four years prior to the filing of this complaint on October 30, 2015.

The plaintiff for this class action signed up for a free trial of the dinner kit subscription on Gobble’s website. The complaint alleges that at that time Gobble did not present the automatic renewal terms in a clear and conspicuous manner, as required by California law.

The plaintiff later signed onto Gobble’s website and opted to skip the next delivery of the dinner kits. However, about a week later, Gobble automatically charged her credit card for another week’s delivery of dinner kits. In doing this, Gobble had charged her for an automatic renewal without obtaining her affirmative consent. Gobble still failed to properly present the terms for the automatic renewal of the subscription.

The complaint alleges that Gobble has violated California law by doing the following:

  • failing to present its renewal offer terms in a clear and conspicuous manner;
  • charging the customer’s credit card for an automatic renewal without first obtaining the customer’s affirmative consent; and
  • failing to provide an acknowledgement that includes the renewal terms, cancellation policy, and information regarding how to cancel, in a manner that the customer can retain; and also failing in the free offer acknowledgement to disclose how to cancel before the customer has to pay.

The complaint alleges that Gobble has therefore violated sections of the California Business and Professional Code.
