Gerber Food Products Misleading “Non-GMO” Claims Class Action

Gerber Products Company makes nutritional food products that it represents as being “Non-GMO,” or not containing ingredients obtained from genetically-modified organisms. The complaint for this class action alleges that those representations are false, because it claims the products do contain ingredients derived from GMO sources.

The class for this action is all persons in the US who, during the applicable statute of limitations period and up to the date of final judgement in this case, bought any of the products at issue. The products at issue include these products and product lines:

  • Gerber Good Start Soy Infant Formula
  • Gerber Good Start Gentle Infant Formula
  • Gerber Good Start GentlePro Infant Formula
  • Gerber Good Start GentlePro 2 Powder Infant Formula
  • Gerber Good Start SoothePro Powder Infant Formula
  • Gerber Good Start Gentle Supreme A2 Powder Infant Formula
  • Gerber Good Start Gentle Supreme A2 Toddler Drink
  • Gerber Good Start Extensive HA Powder Infant Formula
  • Gerber Good Start Grow Powder Toddler Drink
  • Gerber Supported Sitter 1st Foods, DHA & Probiotic Baby Cereal
  • Gerber Sitter 2nd Foods, Probiotic Baby Cereals
  • Gerber Oatmeal & Barley Toddler Cereals
  • Gerber Toddler Pouches
  • Gerber Lil’ Crunchies
  • Gerber Teether Wheels, Apple Harvest Crawler Snack
  • Gerber Mealtime Harvest Bowls

According to the complaint, all of these products are labeled as being “Non-GMO” but do contain GMOs.

The complaint alleges that Gerber labels “every Product sold in the United States as ‘Non-GMO’” and that it “does this because consumers perceive all natural foods as better, healthier, and more wholesome.” Among alleged consumer concerns about GMOs, the complaint lists the following:

  • Health risks associated with GM crops.
  • Concern about ingestion of pesticides and other toxic substances.
  • Interest in sustainable living and local farming.
  • Negative environmental effects associated with growing GM crops.

According to the complaint, consumers “reasonably understand [non-GMO] claims to mean that a product was produced without genetic engineering and its ingredients are not derived from GMOs.” However, the complaint claims, Gerber’s products “are in fact loaded with ingredients derived from GM-crops such as corn and soy, and may of [Gerber’s] Products also contain numerous artificial ingredients that were genetically engineered in a laboratory setting using biotechnologies.”

The complaint alleges, “As of 2021, approximately 93% of canola, 92% of corn, and 94% of soybeans grown in the United States are genetically modified, as are 95% of sugar beets.”

The complaint alleges that Gerber’s “Non-GMO Claims are misleading and highly deceptive to reasonable consumers.”
