Future Motion Onewheel XR Model 4206 Abruptly Shuts Down Class Action

Future Motion, Inc. markets its Onewheel XR Model 4206 battery-operated, motorized skateboard as an exciting experience, says the complaint for this class action. But perhaps it’s a little too exciting, because the complaint also alleges that it may suddenly shut off while it’s running at speed, causing the user to crash. The complaint alleges that the Model 4206 is unsafe for its intended use because of this defect.

The class for this action is all persons in the US who bought a One Wheel Model 4206 between October 15, 2017 and the date of trial in this case.

The Onewheel XR Model 4206 has the capacity to run at speeds of up to around nineteen miles per hour. It is advertised as being able to run on sidewalks or off-road. But the complaint alleges that it has a circuit board defect that results in abrupt shutdowns, even while it’s running at speed.

Plaintiff Isaac Jacobson took his Model 4206 out for a ride on December 24, 2018, along with his brother who was also riding a Onewheel.

According to the complaint, he was traveling on the Model 4206 at about ten miles per hour when it suddenly shut off. “This shut off caused the front of the vehicle to slam into the road[,]” the complaint alleges, “and threw [Jacobson] forward into the ground. The momentum carried his legs and lower body over his head and tore his left shoulder from its socket.” His brother was able to help him get home and get medical attention.

When the accident happened, Jacobson checked the battery level, suspecting that the shut off was caused by running out of power. However, the battery showed that it still had 91% power. After that, he was unable to turn the Onewheel back on again. At the time, the Onewheel was still under warranty.

According to the complaint the Facebook group for Onewheel users “contains multiple references by multiple users referring to this problem.” It charges that Onewheel cannot claim to be ignorant of the problem because of these postings and because it “has repeatedly repaired the circuit boards of numerous [of the Model 4206’s] when presented under warranty…”

Yet Onewheel has not sent out any warning or issued a recall on the Model 4206. The complaint says that “it is now up to the Court to protect the consuming public from this unreasonable safety risk.”

The causes of action include violations of California state laws, negligence, and Strict Products Liability—Design Defect and Failure to Warn, among other things. The complaint alleges that the product is “unsafe for its intended use[.]”
