This complaint opens with the words, “The Covid-19 pandemic has already killed over 100,000 Americans, left record numbers unemployed, and triggered a global economic downturn.” Attempts to curb the spread of the disease have led to a severe drop in air travel, which in turn has led airlines to cancel flights. However, the complaint alleges that when Frontier Airlines, Inc. cancels its flights, it refuses to refund passenger tickets.

The class for this action is all persons living in the US who bought tickets for a Frontier Airlines flight scheduled to fly on or after March 1, 2020, where the flight was canceled or significantly delayed, and who did not receive a full refund within 20 days of the cancellation.

The Covid-19 epidemic has led to draconian restrictions as well as economic hardship for millions of Americans. It is thus all the more important, then, the complaint says, “[a]t a time when many are struggling to get by and cash is at a premium,” that airlines promptly refund tickets for passengers whose flights they cancel.

Plaintiff Lakinya Bess bought tickets from Frontier for a flight from San Francisco, California to Baltimore, Maryland on March 17, 2020. Frontier canceled the flight and sent Bess an email, asking if she wanted a credit or a refund. Bess replied with a request for a refund. Frontier said the processing would take five to seven days.

However, it then sent her another email saying she’d received a credit of 20,000 miles. She answered by email, protesting that she’d asked for a refund, not a credit. The complaint claims, “She was told that by opening the email with the credit offer, she’d accepted it.” She had still not received the refund.

Frontier is a large airline. Last year, it took in over $2.5 billion dollars. However, with travel restrictions in place, it has lost many passengers and has canceled 90% of its flights. Its own Contract of Carriage requires it to make refunds when it cancels flights and the passenger has no suitable alternatives.

The Department of Transportation (DOT) requires airlines to provide full refunds to passengers when it cancels flights. In 2011, it reiterated this requirement, saying in part, “We find it to be manifestly unfair for a carrier to fail to provide the transportation contracted for and then to refuse to provide a refund if the passenger finds the offered rerouting unacceptable … and he or she no longer wishes to travel.”

DOT issued another notice on April 3, 2020, saying, “Although the Covid-19 public health emergency has had an unprecedented impact on air travel, the airlines’ obligation to refund passengers for cancelled or significantly delayed flights remains unchanged.” The complaint adds, “Frontier and other airlines who were denying their customers refunds were warned that they would be subject to future enforcement actions if they did not timely remedy their non-compliance.”
