Ford Motor Credit Wrong Number Calls TCPA Class Action

The Telephone Consumer Protection Act (TCPA) tries to protect consumers from unwanted telemarketing. However, the complaint for this class action alleges that the Ford Motor Credit Company, LLC, which does business as Ford Credit, still makes unwanted calls to consumers, including making calls to people other than those it is purportedly seeking, and making such calls even after the recipients ask them to stop.

The class for this action is all persons in the US who, between March 18, 2017 and the present (1) received a non-emergency call to their cellular telephone numbers (2) placed with an automatic telephone dialing system or an artificial or prerecorded voice (3) by Ford Credit, (4) who were not Ford Credit customers at the time of the calls.

The TCPA forbids business to use automatic telephone dialing systems (ATDSs) or an artificial or prerecorded voice to call consumer cell phones, except in case of an emergency, unless that business has the prior express written consent of the cell phone owner.

One of the two plaintiffs in this case, Jeanninne Coleman, has been receiving calls from Ford Credit to her cell phone, even though she has no relationship to the company and has never been associated with it. She claims never to have given her consent to be called by it. The complaint alleges that some or all of the calls made to her phone were made with an ATDS or an artificial or prerecorded voice.

The artificial or prerecorded voice on the calls claims to be looking for someone called Kendy Taupier or Heather Taupier. Coleman has explained to the company that she is not the person it is looking for and has asked it not to call her again. However, the calls persist.

The other plaintiff, Christopher Bush, claims to have received twenty-nine calls from Ford Credit over the past four years, some or all of which were placed using an ATDS or prerecorded voice. These calls were also made regarding an account with Ford Credit that belongs to someone else. Bush claims he is not a Ford customer and has never had a business relationship with the company.

Bush answered several of the calls, the complaint alleges, and told the company that he was not the person it was looking for. Still, the calls did not stop. The complaint alleges that Ford Credit did not have his consent for any of the calls.

Negligent violations of the TCPA bear a statutory penalty of up to $500 per call. The complaint alleges that the violations were willful and knowing, since they continued even after the plaintiffs asked the company to stop calling. Apparently, the complaint says, Ford Credit’s “corporate policy doesn’t provide for regular skip tracing to verify the cell phone subscriber has not changed.”
