Eva Naturals Products “Natural” Representations Class Action

The very name of Eva Naturals, Inc. seems to represent that the company’s products will be “natural”—that is, that they will not contain synthetic ingredients. At least, that’s the claim that the complaint for this class action makes. It points to the “Naturals” name on the label and alleges that the company is marketing the products as natural despite their containing synthetic substances.

The class for this action is all consumers who bought the products at issue in the US during the applicable statute of limitations period. A New York Subclass has also been defined for those who bought the products in New York.

The complaint quotes the Eva Naturals website as saying that “Eva Naturals is a family-owned company with a reputation for high quality, natural skin care products. We believe in staying natural in our formulations…”

But the complaint alleges that the representation that the products are “natural” is “false, misleading, and deceptive” because they contain number synthetic substances. It shows images of the products and lists synthetic substances they allegedly contain.

These synthetics include citric acid, stearic acid, tocopherol, cetearyl alcohol, panthenol, phenoxyethanol, cocamidopropyl betaine, potassium sorbate, lactic acid, decyl glucoside, sodium hydroxide, carbomer, and many others.

Also in the complaint are explanations of these substances and allegations about their effects. For example, it says that citric acid is no longer made from citrus fruit but manufactured from “certain genetically mutant strains of the black mold fungus” and that phenoxyethanol “is toxic by definition under federal law,” while potassium sorbate is a preservative that may have “genotoxic effects on humans and other mammals” and may cause “chromosomal aberrations in cells, which can trigger the development of cancer.”

The causes of action include violations of New York’s General Business Law, breach of express warranty, and unjust enrichment.
