
Eufy home security cameras appear to have been pitched to consumers who value the privacy and security of their images and information, but the complaint for this class action alleges that the companies responsible for them falsely represented their operations. The complaint brings suit against Anker Innovations Limited, Anker Technology Corporation, and Fantasia Trading, LLC, alleging that their claims to use superior encryption and to store information locally, within the camera, are false.
- The Nationwide Class for this action is all individuals in the US who bought a Eufy camera for personal or household use, and not for resale, during the applicable statute of limitations period.
- Also, or in the alternative, a New York Class has been defined as all individuals in New York State who bought a Eufy camera for personal or household use, and not for resale, during the applicable statute of limitations period.
The product line involves doorbell and other security cameras, including the eufyCam product line, the SoloCam product line, and the Solo Indoor Cam product line.
According to the complaint, the companies advertised that the cameras store images locally, that they employ facial recognition locally, with “no cloud,” and that they use “military grade” encryption. The complaint quotes some statements made by the companies in marketing materials, including the following:
- “[Y]our recorded footage will be kept private. Stored locally. With military-grade encryption. And transmitted to you, and only you.”
- “All recorded footage is encrypted on-device and sent straight to your phone—and only you have the key to decrypt and watch the footage. Data during transmission is encrypted.”
- “There is no online link available to any video.”
However, the complaint alleges that, in November 2022, a technology security researcher “reveal[ed] that Eufy cameras upload images and facial recognition data to [the companies’] cloud storage, which is hosted by a third party”—Amazon Web Services (AWS)—“even where the user did not sign up for cloud storage or services. It was further revealed that separate Eufy cameras linked to other accounts can identify a user’s face…”
“The researcher also showed that persons can view live footage from Eufy cameras over web browsers,” the complaint alleges, “without logging in or otherwise providing any authentication, by using the correct web address, showing that Eufy cameras did not use end-to-end encryption.”
When challenged with these revelations, the complaint claims, the companies said it was an “oversight” and “error” to have made the representations they did, and said they would change their marketing materials. However, as of December 2022, the complaint alleges that the companies still claim to operate with “no cloud” and make other claims that are likely to mislead consumers.
