E-ZPass System Overcharges for Motorcycles Class Action

The E-ZPass system is an electronic tolling collection system that allows drivers to put a small transponder on their windscreens and pay tolls electronically as they pass through toll points. The problem alleged by this class action is that motorcycles that use the E-ZPass system may be charged as a different class of vehicle. They may therefore be charged excessive fees, “without notice, without their knowledge, and without providing any meaningful process to dispute or appeal the charges.”

The Nationwide Class for this action is all persons or entities in the US who bought or used the E-ZPass electronic toll system for motorcycle equipment. A New York Subclass has also been defined, for persons or entities in the above group in New York.

The defendants in this case are Conduent, Inc., Conduent State & Local Solutions, Inc., and Triborough Bridge and Tunnel Authority (TBTA). This last company does business as MTA Bridges and Tunnels or New York E-ZPass Service Center.

The E-ZPass system allows drivers to pay tolls by having an electronic tag on their windscreens. The tag can be detected by a reader that transmit account information to a toll agency, which then charges the toll to the customer’s account.

However, if motorcycle customers are charged too much, it is difficult for them to rectify the situation. The complaint alleges, “Any attempts … are encumbered by an unnecessarily complicated login and security system, and then further encumbered by customer service representatives who provide incorrect, confusing, and often misleading information.” Some of the representatives do not understand the differences between the vehicle classes, the complaint says, which make it even more difficult to dispute mistaken charges for motorcycles.

The plaintiff in this case, Charles Antonelli, owns two motorcycles and has an E-ZPass transponder for each through the E-ZPass Service Center. Although he does not own any other vehicles, his accounts have sometimes been charged for Class 1 vehicles (cars) or Class 9 vehicles (trucks).

Antonelli tried to correct the incorrect billing by calling the E-ZPass Service Center, but the complaint alleges he “was told that it cannot change the bill, but that they would open up a case and transfer him to another department [which] could help him. The department he was transferred to did not provide him with a solution. To date, TBTA has failed to solve the classification issue and continues to overcharge him due to incorrect vehicle classifications caused by malfunctions in [the] equipment.”

The E-ZPass system now includes toll agencies in nineteen states.

The counts include breach of contract and of the implied covenant of good faith and fair dealing and fraudulent concealment, among other things.
