Dry Shampoos and Conditioners Benzene Content Class Action

Consumers have become increasingly aware of the presence of synthetics and chemicals in their foods, cleaners, and other products in recent years. It must have come as a shock to many when a number of aerosol personal care products from prominent companies were found to contain benzene, a carcinogen. Recent cases have pointed to aerosol antiperspirants; this class action concerns aerosol dry shampoo and dry conditioner products from the Procter & Gamble Company (P&G).

A class and a subclass have been defined for this action:

  • The National Class is all persons or entities who bought the products at issue anywhere in the US, for personal use and not for resale, at any time during the applicable statute of limitations period.
  • The New York Subclass is all persons or entities who bought the products at issue in New York, for personal use and not for resale, at any time during the applicable statute of limitations period.

The products at issue include the following:

  • Waterless Dry Conditioner Instant Moisture
  • Waterless Dry Shampoo No Residue
  • Pantene Sultry Bronde All in One Luxury Mist
  • Pantene Smooth Talker Dry Conditioning Oil
  • Pantene Mist Behaving Dry Conditioning Mist
  • Pantene Gold Series Instant Nourishing Spray
  • Pantene Dry Shampoo No Water Refresh
  • Pantene Dry Shampoo Sheer Volume
  • Pantene Never Tell Dry Shampoo
  • Herbal Essences Blue Ginger Refresh Dry Shampoo
  • Herbal Essences White Grapefruit & Mint Dry Shampoo
  • Herbal Essences White Strawberry & Sweet Mint Dry Shampoo
  • Herbal Essences Cucumber & Green Tea Dry Shampoo
  • Old Spice Fiji Dry Shampoo
  • Old Spice Pure Sport Dry Shampoo

“Benzene,” the complaint says, “has been recognized, acknowledged, and accepted as a well-known health hazard and human carcinogen for approximately a century.” It has been named as a carcinogen by organizations like the National Toxicology Program and the Centers for Disease Control.

People can be exposed to benzene through the lungs and the skin. According to the complaint, “This makes, benzene exposure from body sprays especially troubling because the spray is put directly onto the skin, with the remnants flying through the air likely to be least partially breathed in by the user and absorbed into their lungs. Thus, even a relatively low concentration limit can result in very high total benzene exposure.”

The complaint alleges that P&G’s “advertising and marketing campaign is false, deceptive and misleading because the Product contains benzene, which [P&G] does not list or mention anywhere on the Product’s packaging or labeling.”

The complaint claims that a product that contains a known carcinogen “has not value[,]” and that consumers who bought the products containing benzene “lost the entire benefit of their bargain…”
