This lawsuit is brought by Shirley Johnson for the neglect and wrongful death of her sister, Evon Williams, at Courtyard Rehabilitation and Health Center, a nursing home, where Williams lived from approximately March 2007 until her death on March 14, 2013.
The complaint alleges that Williams suffered various injuries from the negligent care at Courtyard, including yeast infections, urinary tract infections, PEG (direct-to-stomach feeding) tube errors, medication errors, and dehydration necessitating multiple trips to the hospital, all of which accelerated the deterioration of her health and finally led to her death.
The defendants in this case are a number of companies as well as individuals who owned, controlled, managed, provided services to, or administered Courtyard. The complaint also holds responsible the nursing home’s governing body and administrator, which it says must set and implement policies for the management of a nursing home as well as be ultimately responsible for the conduct of the nursing home.
According to the complaint, the defendants ran Courtyard so as to maximize profits, keeping staff levels lower than required, so that staff on duty at any time were unable to provide proper care to the residents. The complaint charges that the defendants permitted high staff-to-patient ratios, did not take into consideration how much mental acuity patients had, and disregarded the minimum time needed to perform services for the patients.
The complaint charges Courtyard with a number of failures in its duties to Williams and other residents, including the failure to assign nursing personnel to duties in keeping with their education and experience and the needs of patients, the failure to terminate employees who were careless, incompetent, or unwilling to comply with proper procedures, rules, and regulations, and the failure to provide sufficient personnel to ensure that Williams received timely and accurate assessments, and proper treatment, medication, and diet.
The complaint also alleges that Courtyard failed to follow state laws and regulations, such as in failing to establish and implement abuse prevention policies, failing to provide necessary levels of care and services, and failing to provide and revise a nursing care plan for Williams that met her needs. It alleges negligence, medical malpractice, breach of Courtyard’s Admission Agreement, Violations of the Long-Term Care Facility Residents Rights Act, and other violations, and alleges that Courtyard’s administrator was negligent.
