CoSport 75% Refunds for Olympic Packages Class Action

The 2020 Summer Olympics were scheduled to be held in 2020 in Tokyo, Japan. They were postponed until the summer of 2021 because of the Covid-19 pandemic. While they will take place then, it has been announced that no international spectators will be allowed to go to the games. This class action brings suit against Jet Set Sports, LLC, which does business as CoSport, because it is refusing to provide full refunds for the tickets and packages it sold for the games.

The class for this action is all persons in the US who bought tickets and accommodation packages from CoSport for the 2020 Tokyo Olympic Games and entered into a CoSport Terms and Conditions of Sale Agreement substantially in the form of Exhibit A to the complaint.

CoSport is described as “the sole entity authorized to sell tickets [to the 2020 games] to the American public.”

Plaintiff Suzanne Caruso bought a Tokyo 2020 Olympic Games SS package from CoSport for $16,375. The package included tickets for events plus handling fees, plus five nights and daily breakfasts at the Keio Plaza Hotel, along with “pre-games and onsite management.”

The games were originally scheduled to start on July 24, 2020, but on March 24, 2020, they were postponed to start on July 23, 2021. A number of health precautions were announced as well.

CoSport provided updates to those with tickets, including a January 2021 report that rumors that the games would be canceled were untrue. The company reopened ticket and package sales on February 8, 2021. A March 12, 2021 update contemplated the possibility of international spectators being barred from the Olympics and noted that “CoSport would be unable to provide an immediate refund…”

On March 24, 2021, the International Olympic Committee and Japanese organizers banned international spectators from the games. On the same day, CoSport provided an update that only spoke of the refunds taking time.

Now, however, CoSport is saying it will not provide Americans with full refunds. Instead, it has offered to provide a 75% refund, and then only under certain conditions: (1) that the customer asks for the refund by the eight-day deadline, and (2) that the customer agrees to hold CoSport harmless for the other 25% they are owed for the refund.

The complaint claims that this is not only a breach of contract but violates two state laws: the New Jersey Consumer Fraud Act (CFA) and the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA).
