Clif Blok Energy Chews Amount of Caffeine Per Cube Class Action

Clif Bar & Company makes eleven flavors of Clif Blok Energy Chews, three of which are the subject of this class action. These include the Black Cherry, Tropical Punch, and Orange flavors, all of which contain caffeine. The complaint for this class action alleges that the product labeling is unclear as to whether the “25mg” or “50mg” of caffeine in the product is the amount per cube or per package.

A class and two subclasses have been defined for this action:

  • The Nationwide Class is all persons in the US who bought Clif Bloks Energy Chews in the Black Cherry, Tropical Punch, or Orange flavors during the applicable statute of limitations period.
  • The New York and California Subclasses are all persons in New York or California, respectively, who bought the Clif Bloks Energy Chews in the Black Cherry, Tropical Punch, or Orange flavors during the applicable statute of limitations period.

Page 1 of the complaint shows images of all three bars. On the front of the Black Cherry variety are the words, “+50mg Caffeine.” On the fronts of the other two varieties are the words, “+25mg Caffeine.” The complaint alleges, “Reasonable consumers … would understand this representation to mean that each cube of the Product contains 25mg or 50 mg of caffeine.”

Page 2 shows an image of the ingredient panel for the products, which specifies that the package contains two servings of three cubes each, but which does not state the amount of caffeine per serving, per cube, or per package. The complaint alleges that the nutrition and ingredient information at the product website also does not specify the amount of caffeine per cube.

The website further confuses the issue, the complaint alleges, by listing three things in a larger font: “100 Calories,” “50mg Sodium,” and “50mg Caffeine.” The first two have an asterisk that connects to the notation “Per serving.” The third, the caffeine amount, has two asterisks that connect to a statement about this not being suitable for pregnant or nursing women, children under 18, or people who are sensitive to caffeine. The complaint alleges that this leaves consumers with the impression that the amount of caffeine is per serving.

In reality, the complaint claims, the product contains the stated amount of caffeine in three blocks, or per serving, not per cube.

Since the product is targeted to those who want to improve their performance in physical activities, the complaint says, the amount of caffeine matters. The true information, the complaint claims, can be found only underneath a flap on the bottom of the package, or buried in a FAQ on the website.

The complaint claims that “consumers are effectively getting only one-third (1/3) of the advertised amount of caffeine per package of the product.”
