Champion Toilet Gasket Failure California Class Action

On YouTube, American Standard Brands (AS America, Inc.) has an advertisement that shows its Champion brand toilet flushing a bucket of golf balls. But the complaint alleges that the Champion toilet is actually designed and made with an “improperly designed and manufactured” gasket or flush valve that can fail prematurely, cause the toilet to use an unusually large amount of water, and require frequent repairs and monitoring.

The class for this action is all persons or entities living in California who bought a Champion model toilet made by AS America, Inc. or its subsidiaries or affiliates within the applicable statutes of limitations.

The Champion toilet is advertised as having a WaterSense certification, which is an assurance that the toilet will minimize the consumption of water, both to conserve water and to save on water bills. The complaint calls this “a feature that is of particular importance to California consumers during the state’s historic drought.”

However, the complaint claims that it does not live up to this claim because of its faulty gasket and valve assembly.

The gasket and valve assembly are supposed to keep the water in the toilet’s holding tank from draining into the toilet until it is flushed. However, the complaint alleges that it doesn’t perform this duty well over time.

First, the complaint claims, “[t]he gasket itself is a rigid material that often fails to maintain a watertight seal. Additionally, the gasket, when submerged in water as it is intended to be, will blister over time and absorb water[.]”

“The blister on the seal creates a leak path,” the complaint alleges, “allowing water to leak down the flush valve mechanism causing unanticipated water loss and increased water bills[.]”

There’s another problem as well, the complaint says: “The leak path can also cause the toilet to periodically flush on its own, also known as ‘ghost-flushing.’”

The complaint alleges it also “did not exhibit the outsized flushing power that [American Standard Brands] promised and failed to even evacuate liquids from the bowl.”

The plaintiff in this case, Robert Weiss, the complaint says, “was initially perplexed by this failure … but, after much investigation, eventually noticed that the water levels in the toilet tank would drop roughly an inch and a half a day” even when no one was using it. He concluded that this was because of the water seeping through the gasket or valve assembly.

Weiss asked American Standard Brands to fix the toilet. According to the complaint, instead of doing so, the company sent him three sets of new gaskets and told him to do the repairs himself.” Weiss did so, but he claims the new gaskets began to fail within a few months. The company then sent him three sets of valve assemblies, but refused to engage a plumber to install them.

The complaint alleges that the company has known about the problem for a long time but fails to warn purchasers.
