Brinks Home Security Text Messaging Charged For but Not Provided Class Action

Defendants LiveWatch Security, LLC and Monitronics International, LLC have done business under a number of names, including Brinks Home Security, Bolster, LLC, and Safemart. Among the services they were purportedly providing to their home security customers was a text messaging alert system that allowed subscribers to receive messages when their alarm systems were activated and turn off the systems remotely. However, the class for this action alleges that the system has long been turned off, even though subscribers are still having to pay a monthly charge for it.

The class for this action is all persons who paid one or more fees to Brinks Home Security for Brinks Home Interactive Messaging for a property in New York state, powered by ASAPer, after Brinks Home Security discontinued or deactivated the service.

The text message alert system was known as Brinks Home Interactive Messaging. This service purportedly would message Brinks subscribers if their alarm systems were activated. The messages would have a link to a portal that they could use to deactivate the alarm.

Plaintiff Jacob Silver pays Brinks Home Security for the monitoring of his home security alarm system. At some time around 2018, he began to notice a new charge on his bill, of $2.95 plus applicable taxes, for the Brinks Messaging system. Silver had not asked for the service and was not aware that it had been added until after he started being billed for it.

The complaint claims, “On at least three occasions since Mr. Silver was enrolled in Brinks Messaging, his alarm system was activated, but he did not receive a text from Brinks with a link to allow him to turn the alarm off.”

One of the occasions was in February 2020. After he failed to receive a text from Brinks for that incident, he contacted the company’s customer service to complain. The complaint says that he spoke to several representatives of the customer on the phone, and that eventually “a representative of Brinks Home Security explained to Mr. Silver that the Brinks Messaging System had been discontinued/deactivated for some time due to technical problems.”

This is how Silver found out that he was still paying for a service that the complaint alleges had been terminated by at least March 2019.

The counts in the complaint include violation of New York’s General Business Law (for false advertising and unlawful deceptive acts and practices), breach of contract, and unjust enrichment.
