
When a company makes a promise about larger paper towel rolls—for example, “12 Singles Plus = 18 Regular Rolls”—does anyone ever count the sheets to make sure this is true? Apparently, some people do. The complaint for this class action alleges that the Procter & Gamble Company (P&G) does not keep its promises about the number of sheets contained in certain of its Bounty Select-A-Size multi-roll packages.
The class for this action is all persons in the US who bought the products from January 1, 2018 through December 31, 2021, not for resale.
The complaint alleges that P&G “engaged in a uniform labeling and marketing campaign designed to convince consumers that its multi-roll Select-A-Size paper towels, including its Singles Plus Rolls and Super Rolls, amongst others…, contain more paper towels than is the case.”
An example given in the complaint is Bounty Plus Select-A-Size Singles. The complaint shows an image of the packaging, which bears the claim, “12 Singles Plus = 18 Regular Rolls,” highlighted in yellow, on the front. At the bottom of the packaging, a note tells customers that each Singles Plus Roll contains 83 sheets. The package of twelve Singles Plus Rolls therefore have 996 sheets of paper towels.
But the complaint alleges that P&G’s website says that each Regular roll of the product consists of 63 sheets. Page 2 of the complaint shows an image of this information on the website.
In that case, 18 regular rolls hold 1,134 sheets (18 rolls x 63 sheets), the complaint alleges. But the 12 Singles Plus packages hold only 996 sheets, or 87.8% of what they promise, the complaint claims, shorting the customer by 138 sheets, or more than two full regular rolls of paper towels.
The complaint alleges, “P&G has similarly shorted customers on other multi-roll packages of Select-A-Size paper towel products…”
As another example, the complaint shows a different package of the Select-A-Size paper towel products, this time promising that 12 Super rolls equal 22 regular rolls. According to the complaint, 22 regular rolls should equal 1,386 sheets (22 rolls x 63 sheets). But the package, shown on page 7 of the complaint, says that the Super rolls contain 101 sheets each, which means the 12 rolls provide only 1,212 sheets, or 87.4% of what the package promises.
The causes of action include breach of express warranty, violation of state consumer protection laws, and fraud, among other things.
