Certain metals are stronger than other metals, making metal composition an important characteristic for consumers looking to buy tools. The complaint for this class action alleges that Robert Bosch Tool Corporation advertises that certain of its drill bits as being “titanium” when in fact they are not made of that material.
The class for this action is all consumers who bought the products anywhere in the US during the applicable statute of limitations. A New York Subclass has also been defined for those who bought the products in New York.

According to the complaint, “certain metals, such as titanium, are significantly stronger than other materials, which means they have better strength-to-weight ratio, corrosion resistance, and a higher melting point as compared to competing products. Additionally, titanium is a high-speed steel known for its durability.” Consumers therefore expect better performance and longer life from tools made with higher-quality metals.
However, the complaint alleges that Bosch falsely advertises certain of its drill bits as being “titanium” when they are not.
The complaint alleges, “Testing on the Titanium Drill Bit Set confirms that the Titanium Product’s base metal is made of an inferior quality ‘nonstandard-US tool steel alloy,’ and the coating is a titanium nitride (TiN) ceramic coating of .00001535 inches.”
According to the complaint, consumers believe that a product labeled as being titanium will actually be made of titanium. “Instead,” it claims, “the Products are covered with a virtually nonexistent coat of an entirely different compound.”
The complaint claims that consumers pay a premium for the drill bits over those that are not advertised as being titanium.
