Arlo Security Cameras Free Cloud Storage Discontinued Class Action

Arlo Technologies, Inc. makes security products that provide electronic images, including cameras, doorbells, and floodlights. Certain of its products have been sold with a promise of “7-Day Free Cloud Storage,” but the complaint alleges that the company is now going back on this promise and has announced end-of-life dates for this service.

The class for this action is all persons who, between November 1, 2014 and the present, bought the products at issue, for household or business use and not for resale. The products at issue include at least the following:

  • VMC3030 (Gen 3)
  • VMC4030 (Pro)
  • ABC1000 (Baby)
  • VMC4030P (Pro2)
  • VMC3040 (Q)
  • VMC3040S (Q+)
  • ALS1101 (Lights)
  • AAD1001 (Audio Doorbell)

The packaging for the products stated that they came with seven days of cloud storage on a rolling basis, provided at “$0,” “without a contract or monthly fee,” according to a “Basic” subscription plan that “never expires!” The company website stated that this “plan is included with every camera, for up to 5 cameras per account.”

For example, the complaint quotes the website entry for the Arlo Gen 3 (VMC3030) as saying, “Use the Arlo app to check in from anywhere. Or rewind up to 1GB of free cloud recordings to see activity you missed.”

As another example, the complaint quotes the website entry for the Arlo Pro (VMC4030) as saying, “Why commit to a long-term contract or pay expensive monthly subscription fees? Arlo can save you hundreds of dollars a year. The Arlo Basic plan gives you access to motion- and audio-triggered recordings from the past 7-Days [sic]. And the plan never expires!”

Arlo knew that this offer would be material to consumers shopping for such products, the complaint alleges, “as shown by its decision to market and advertise that feature in multiple prominent positions on its packaging and website.”

Even so, on the first day of 2023, the complaint alleges, the company put out an announcement of an End-of-Life (EOL) Policy that applied to products that had already been purchased. According to the complaint, this announcement said that the free cloud storage “may be reduced or unavailable” as of its EOL effective date and listed all EOL effective dates as either April 1, 2023 or January 1, 2024.

The complaint alleges that Arlo has therefore breached its contracts with its “negligent, reckless, and/or knowingly deceptive conduct[.]”

Although the company has an arbitration provision in its Terms of Service, the complaint calls it “poorly drafted, ambiguous, and unconscionable” and “unenforceable.”
