This lawsuit claims that Amazon Processing violated the Telephone Consumer Protection Act (TCPA) by contacting plaintiffs and other consumers on their cellular phones using an automatic dialing system and leaving prerecorded and artificial messages.
On July 8, 2015, Keisha Newsom received a telephone call from Amazon Processing. She was contacted by the company by the use of an automatic dialing system and an artificial voice. This call, and other similar calls to other consumers, were made to market Amazon Processing’s electronic payment processing equipment and solutions. Prior to this call, Newsom had no relationship with the company and at no time did she give them consent to contact her. Amazon Processing contacted Newsom with the telephone number “(804) 872-0867.” This phone number belongs to a call center that they frequently use to market credit card processing products.
The TCPA was designed to prevent calls and messages like ones received by Keisha Newsom and to protect the privacy of citizens. In enacting the TCPA, Congress intended to give consumers a choice as to how creditors and telemarketers may call them, and made specific findings that “[t]echnologies that might allow consumers to avoid receiving such calls are not universally available, are costly, are unlikely to be enforce, or place an inordinate burden on the consumer.” Congress also decided that automated and prerecorded calls are a nuisance to Americans and an invasion of privacy.
Based on the facts of the case, the plaintiffs allege that Amazon Processing committed negligent and willful violations of the Telephone Consumer Protection Act by using an automatic capable dialer to contact consumers with a pre-recorded or artificial message.
