ADT, Safe Streets Telemarketing Text Messages TCPA Class Action

ADT, LLC provides alarm and monitoring systems for security and fire protection. One of its oldest and largest authorized dealers is Safe Streets USA, LLC, which sells and installs security systems that ADT monitors. The complaint for this class action alleges that the companies market the security systems and services by sending realtors text messages, in ways that violate of the Telephone Consumer Protection Act (TCPA).

Safe Streets has devised a home security dealer program, with which sub-dealers under its umbrella can attain the benefits of being an authorized ADT dealer. That is, they can earn payments for alarm monitoring accounts they pass on to ADT.

In order to promote their programs and services, the complaint alleges, the companies send automated text messages to realtors who have clients who have recently bought homes. They try to get the realtors to send them contact information for the new homeowners so that they can offer them security and monitoring services.

Plaintiff Lauren Davis is a realtor in the Dallas, Texas area. On or about April 15, 2019, she received a text message from the companies that began, “Lauren, Congratulations on helping your buyers settle on their new property. Now give them the gift of Home Security.”

Above the message was an image of various components of a home security system with an ADT logo. The message went on, “We will provide them with a FREE Nest Thermostat, Ring Doorbell, or Yale Key-less Entry Deadbolt courtesy of you. We will also waive any installation fees, and equipment fees so they will only be responsible for the Monthly Monitoring.” The text further offered to send her a “referral gift of $200 just 10-14 days after installation.”

It instructed her to “[s]imply ask if your client is interested and fill out the information below, we will handle everything else.” Below that was a link connected to a sub-dealer page which is meant to take information for both the realtor and her client.

Davis had not given the companies her prior express written consent to send automated telemarketing text messages to her cell phone.

The complaint alleges that the companies are sending unsolicited text message to realtors to get the realtors to provide contact information for new homebuyers so that they can, in turn, send unsolicited marketing message to them and attempt to sell ADT’s home security products and monitoring services.”

The class for this action is all persons who (1) received a text message, sent on or after February 17, 2016, (2) by or on behalf of ADT or Safe Streets (3) in regard to ADT home security services, and (4) for whom ADT and Safe Streets do not claim to have obtained prior express written consent or claim to have obtained prior express written consent in the same manner as they claim to have received it from the plaintiff in this case.
